Disc Zones
Every year, a number of cases come before the Adjudicators concerning Disc Zones.
Lack of local knowledge of disc zones (HAS3)
The appellant, a visitor to the town, was issued with a PCN for parking in a Disc-Zone parking space without displaying a valid disc and appealed on the ground that there was no indication of what a Disc Zone was or how it operated. The Adjudicator held that, although the usual disc zone sign was present and local residents knew what a Disc Zone was, a visitor would not, because there was no information as to where and how discs could be obtained, whether they were free or must be purchased, and so on.
The appeal was allowed.
Allowing a "reasonable amount of time" (ED 20)
The appellant parked in a disc-zone space, read the explanatory notices, went off in search of a disc to display and returned within 10 minutes to find that a PCN had been issued for failing to display a disc in a disc zone. They appealed on the ground that they had not been allowed enough time to obtain a disc. In their evidence, the council said that, in addition to the disc-zone signs, they had also posted other signs explaining where free discs could be obtained (local shops, the Town Hall, etc.). The Adjudicator held that, in view of these signs, a motorist ought to be allowed a reasonable amount of time to walk to a shop, obtain a disc and walk back (i.e., similar to the time allowed for a motorist to buy a ticket from a pay-and-display machine).
The appeal was allowed.
